Terms of service

1. Acceptance of terms

These Terms of Service ("Terms") are an agreement between you and Better Interaction INC, which operates Evident UGC ("Evident", "we", "us"). By accessing or using the Evident website, platform, API, or MCP server, you agree to these Terms. If you use Evident on behalf of a business, you agree to them on that business's behalf and confirm you are authorized to do so. If you do not agree, do not use the service.

2. Description of service

Evident provides a customer evidence platform for ecommerce, including product reviews, loyalty and rewards, UGC galleries, and Q&A functionality. The service is provided through a web-based dashboard (app.evidentugc.com), a storefront widget SDK, a REST API (api.evidentugc.com), and an MCP server (mcp.evidentugc.com) that lets AI assistants and automation tools you connect use the service on your behalf.

3. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. API, AI assistant, and automation access

You may connect AI assistants (such as ChatGPT or Claude) and automation tools (such as Zapier) to your Evident account, either by signing in through the connection flow or with an API key you create. A connected tool acts with the role and permissions of the user who connected it, or the scopes of the API key it uses.

You are responsible for every action taken through a tool you connect, as if you had taken it yourself. Depending on your permissions, those actions can publish or hide reviews and customer photos on your storefront, post public replies to reviews, send review-request emails to your customers, create or change FAQs and loyalty rewards, and add or remove loyalty points that customers can redeem for discounts or store credit.

AI assistants can misunderstand requests and produce inaccurate output. Review what an assistant proposes before approving changes, especially changes customers will see or receive. Text written by the public, such as review content, can contain instructions aimed at an assistant; do not build unattended automation that acts on it.

Data returned to a connected tool is sent to the provider that operates it and is handled under that provider's terms, as described in our Privacy Policy. Keep API keys secret, grant only the scopes a tool needs, and revoke keys you no longer use.

5. Acceptable use

You agree not to use Evident to publish fraudulent or incentivized reviews without disclosure, to send email to people who have not purchased from you or who have opted out, to misuse personal data, to probe or disrupt the service or other customers' data, or to exceed rate limits by circumventing them. You are responsible for having a lawful basis to send your customers the emails you direct Evident to send.

6. Third-party services

Evident integrates with services we do not operate, including ecommerce platforms (such as BigCommerce and Shopify), email providers (such as Klaviyo), automation platforms, and AI assistants. Your use of those services is governed by their own terms. We are not responsible for their availability, their actions, or how they handle data you choose to send them.

7. Payment terms

Paid plans are billed monthly. You may upgrade, downgrade, or cancel your subscription at any time. No annual contracts are required. We do not charge per-order overage fees.

8. Data ownership

You retain full ownership of your data, including reviews, customer information, and loyalty program data. You may export your data at any time, and you may ask us to delete it; deletion follows the timelines in our Privacy Policy.

9. Suspension and termination

You may stop using Evident and close your account at any time. We may suspend or terminate access, including access by a connected tool or API key, if you breach these Terms, if your use threatens the security or stability of the service or other customers, if payment is overdue, or if the law requires it. Where practical we will give notice first. On termination, your right to use the service ends, and your data is handled as described in our Privacy Policy.

10. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service, or any output produced by an AI assistant using it, will be uninterrupted, error-free, or accurate.

11. Limitation of liability

Evident shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, including actions taken by AI assistants or automation tools you connect.

12. Governing law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law rules.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date, and will notify account owners of material changes by email. Continued use of the service after a change takes effect constitutes acceptance of the updated Terms.
